Clapifax Terms of Service

The rules for using Clapifax and its fax service: how credits work, what you may send and what we are responsible for.

Who we are and what these terms cover

Clapifax is provided by Clapilot GbR, represented by Luca Sonntag, Georgenstraße 97, 80798 München, Germany (luca@clapilot.com). These terms apply to the Clapifax fax service and to credits. Your licence to use the app itself is governed by Apple’s standard Licensed Application End User License Agreement.

The service

  • Clapifax sends documents that you scan or import to fax numbers in the supported countries. We transmit faxes through a telecommunications provider (currently Telnyx) over the telephone network. Scanning, signing and printing happen on your device.
  • You can send to landline fax numbers in the countries listed in the app and on the support page. Mobile, premium-rate and other special numbers can’t be faxed. We may add or remove countries.
  • A fax can have up to 50 pages and 20 MB. To prevent misuse, we limit the number of faxes and recipients per hour and per day; the app tells you when a limit applies.

Credits

  • You buy credits as consumable in-app purchases from Apple through the App Store. Apple’s terms apply to the payment, and the App Store shows the price before you buy.
  • 1 credit sends 1 page to the US, Canada, Germany, Austria or Switzerland. Other supported countries use 2 credits per page. The optional cover page is free. Before you send, the app shows the zone, the credits per page and the total; that price applies to the fax.
  • Credits never expire. They belong to your Clapifax account, can’t be exchanged for money and can’t be transferred to other people.
  • Credits are reserved when you send and only used when the fax is delivered.
  • To keep your credits when you reinstall the app or switch devices, back them up with Sign in with Apple. If you delete your account, remaining credits are lost.
  • We may change which zone a country belongs to, for example when telephone rates change. This only affects faxes you send afterwards, and the app always shows the price before you send.

Failed faxes and refunds

  • If a fax can’t be delivered, for example because the line is busy, nobody answers, the number isn’t a fax machine or a technical error occurs, we automatically return all credits reserved for it, even if some pages got through. Busy and unanswered faxes are retried up to 2 times, 5 minutes apart, before they count as failed.
  • Refunds of purchases are handled only by Apple, under Apple’s rules, at reportaproblem.apple.com. We can’t refund App Store payments ourselves. If Apple refunds a purchase, we remove its credits from your balance. If your balance becomes negative, you can’t send until it’s settled; after repeated refunds we may lock the account for review.
  • Your statutory rights are not affected.

Free first fax

We may offer a free first fax under the conditions shown in the app (currently one fax of up to 3 pages to the US, Canada, Germany, Austria or Switzerland, once per device). We can change or end this offer at any time. Using several accounts or devices to get more free faxes is not allowed.

What you may send

You are responsible for the documents you send and for having the right to send them to the recipient. In particular, do not use Clapifax to send:

  • unsolicited advertising (junk faxes). Advertising by fax without the recipient’s prior consent is prohibited, among others, in the US by the Telephone Consumer Protection Act (47 U.S.C. §227) and in Germany by §7 of the Act against Unfair Competition (UWG), and can lead to high damages;
  • illegal content, or content that infringes the rights of others, such as copyright or privacy;
  • threats, harassment or insults, or faxes to people who have asked you not to fax them;
  • fraud, phishing or faxes that pretend to come from someone else;
  • mass or automated faxes.

Don’t try to get around our limits or security measures, for example with several accounts. Clapifax is not designed for organisations that need a business associate agreement under the US HIPAA rules, and we don’t sign such agreements.

Sender identification

US law (47 U.S.C. §227(d)) requires every fax to show, at the top or bottom of each page or on the first page, the date and time it was sent, who sent it and the telephone number of the sender or the sending machine. Clapifax prints the date and time, your name (and company) and your callback number at the top of every page.

Enter your real name or the name of the business you send for, and a callback number that belongs to you or that business. For faxes to the US, always enter a callback number. You are responsible for these details being correct.

Delivery and availability

  • Faxing depends on telephone networks and the recipient’s fax machine, which we don’t control. We can’t guarantee that a fax arrives, arrives by a certain time, or is printed completely and legibly. “Delivered” means that the receiving fax machine confirmed the transmission.
  • The transmission report documents the transmission. Whether it is accepted as proof that the recipient received the fax is up to courts and authorities. If you have to meet a deadline, send in good time and keep the report.
  • We may pause sending for a while, for example for maintenance, for security reasons or when our telephone provider has problems. Faxes that aren’t sent aren’t charged.
  • We may refuse or stop a fax, or lock an account, if there are concrete indications of misuse or a breach of these terms. If you think we did so by mistake, email us.

Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

For slight negligence we are liable only if we breach an essential contractual obligation, that is an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely, and then only for the foreseeable damage typical for this kind of contract. Otherwise we are not liable for slight negligence. These limits also apply to our representatives and the people we use to perform our obligations.

Ending use

You can stop using Clapifax at any time and delete your account in the app (Settings → Account → Delete Account). If we discontinue Clapifax, we will announce it in the app in good time so that you can use your remaining credits.

Changes to these terms

We may update these terms when the service or the law changes. We will publish the new version on this page with a new date and point out material changes in the app. Changes apply to faxes sent afterwards; credits you already have stay valid.

Governing law and disputes

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside. If you are a merchant, the place of jurisdiction is Munich.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

These terms are available in English and German. If the versions differ, the German version prevails.
